What is the Personal Data Protection Law KVKK Information Text?

The KVKK (Personal Data Protection Law) information text is a legal document that provides information to the relevant persons about how an organization collects, processes and stores personal data. This text explains the basic principles of personal data protection and informs the data owners about their rights and the obligations of the data controller. The information text is an important element that data controllers are obliged to fulfill in accordance with the KVKK numbered 6698.

What is the Disclosure Text?

The disclosure text is a document that explains the purposes for which personal data is collected, how it is processed, with whom it is shared, and the storage period of the data. It also details the rights that individuals have under the KVKK. The disclosure text fulfills the obligation of a business to provide transparency to its customers, employees, or website visitors. This text is required to be prepared by every legal and natural person who engages in personal data processing activities.

How should the disclosure text be prepared?

There are some important points to consider when preparing the disclosure text. Legal, clear, transparent and understandable language should be used. Here are the basic steps to follow when preparing the disclosure text:

  • Identity of the Data Controller: The name, address and contact information of the natural or legal person who processes personal data must be stated in the disclosure text.
  • Processed Personal Data and Their Purposes: It should be clearly explained which personal data is collected and for what purposes this data is processed. For example; it should be stated in accordance with which needs data such as name, surname, e-mail address are used.
  • Data Collection Method: The methods by which data is collected (e.g. web form, telephone call, physical document) should be specified.
  • Legal Basis: The legal basis for processing personal data, i.e. the legal regulations under which data is processed, must be clearly stated.
  • Persons to Whom Data Will Be Transferred: It should be explained whether personal data will be shared with domestic or foreign third parties and, if so, who these persons are.
  • Data Retention Period: Information should be provided on how long personal data will be stored and how the data will be destroyed after this period expires.
  • Rights of the Data Owner: According to Article 11 of the KVKK, the rights that data owners have should be detailed. These rights include the right of the data owner to correct, delete and object to the processing of personal data.
  • Application Methods: The procedure that data owners must follow to exercise their rights and how they can apply to the data controller should be explained.

Your personal data is processed by the data controller [Company Name] within the scope of the Personal Data Protection Law No. 6698 (“LPPD”). This information text aims to inform you about the purposes for which your personal data is collected, how it is processed and with whom it is shared.

Your personal data such as name, surname, telephone number, e-mail address are processed to provide our services and provide you with a better experience.
