With the development of the digital world, there are also significant changes in the field of television broadcasting. One of these changes is IPTV (Internet Protocol Television) services. IPTV is a system that allows you to watch television broadcasts over the internet. However, some illegal uses of this technology have also come to the fore. In particular, illegal broadcast providers and users may face legal sanctions.

What is IPTV?

IPTV is an abbreviation for Internet Protocol Television, and is a technology that provides television broadcasting over internet protocol. Unlike traditional television broadcasting, IPTV works over an internet connection and allows users to watch television programs, movies, series or other video content on demand.

How Does IPTV Work?

IPTV transmits content over the internet and allows users to access this content from different devices (such as smart TV, computer, tablet, phone). Unlike traditional broadcasting methods, satellite or cable TV signals are not used, instead data packets are carried over the internet. IPTV can provide service in three main modes:

  • Live Broadcast: Allows you to watch live TV channels over the Internet.
  • Video-on-Demand: Users can choose and watch the content they want, whenever they want.
  • Time-Shifted TV: Allows you to record previously broadcasted content and watch it later.

What are the advantages of IPTV?

  • Flexibility: The viewer can watch the content they want, whenever they want.
  • Compatibility with Various Devices: Can be used on smart TVs, mobile devices and computers.
  • High Quality: Provides access to HD and even 4K quality content when internet speed and bandwidth are sufficient.

Is IPTV Legal?

The licensed and legal content providing versions of IPTV are completely legal. For example, paid IPTV services offered by various broadcasters fall into this category. However, using unlicensed and illegal IPTV services is a crime. Using illegal IPTV can have both legal consequences and expose users to financial penalties and imprisonment.

Although IPTV is a technology that has transformed television viewing habits, it is important for users to choose legal broadcast providers.

Is Using IPTV a Crime?

Using IPTV is not a crime if it is done through a licensed and legal platform. However, using unlicensed and illegal IPTV services is a crime. These illegal broadcasts are evaluated within the scope of the Intellectual and Industrial Property Law and the Turkish Penal Code (TCK). Those who provide illegal IPTV services and those who use these services may face severe sanctions.

What is IPTV Penalty?

Illegal IPTV usage and provision may result in various penalties. Being an IPTV user or provider may result in the following penalties:

  • Prison Sentence: Providing illegal broadcasting services is punishable by imprisonment of 1 to 5 years, according to Articles 71 and 72 of the Turkish Penal Code. People who watch illegal broadcasts may also face the risk of imprisonment for committing a crime.
  • Fines: Watching or broadcasting illegal IPTV streams can result in heavy fines. These fines apply to both broadcasters and users.

How to Detect Illegal IPTV Broadcasting?

Illegal IPTV broadcasts are very easy to detect thanks to today’s technologies. IP address tracking, monitoring of broadcast providers’ signal sources and cooperation with legal platforms can help identify people who broadcast or watch illegally. Cooperation with internet providers in particular helps determine whether users are watching illegal broadcasts via their IP addresses.

What is the crime of the illegal broadcast provider?

Illegal IPTV providers face serious legal liability. They are committing the crime of intellectual property infringement by violating copyrights and broadcasting without a license. This crime can entail imprisonment and fines, as well as financial compensation to legitimate content producers.

What is the crime of watching IPTV?

Watching illegal IPTV broadcasts is a crime. In particular, since it leads to copyright infringement, users are also subject to criminal liability as part of this process. People who watch illegal broadcasts unknowingly support an illegal activity, which paves the way for legal sanctions.

What Happens If Illegal Broadcasting Is Detected?

If illegal IPTV broadcasting is detected, legal action may be taken against both the broadcaster and the users. As a result of the investigations conducted by the prosecutor’s office, those found guilty may be prosecuted. Illegal broadcast users who are detected may face fines and even imprisonment.

Which Court Hears the Case?

Cases related to illegal IPTV broadcasting and viewing are heard by the Intellectual and Industrial Property Rights Court. These courts have jurisdiction especially in cases such as copyright violations. If the crime in question is more extensive, the High Criminal Courts may also step in.

Is It Necessary to Hire a Lawyer for Illegal Broadcasting?

When faced with charges of illegal IPTV broadcasting, it is extremely important to hire a lawyer. Since such cases involve complex legal processes, it will be in the person’s best interest to get professional help. An expert Criminal Law lawyer can both defend against the charges and fulfill the necessary objections and applications in a timely manner.

In order not to encounter legal problems, you should always prefer licensed and legal broadcast providers. For detailed information on IPTV and copyright violations, you can learn your legal rights by meeting with an expert lawyer in Çorlu.
