What is the Penalty for Drunk Driving? Is Your License Confiscated?

Drinking and driving is a dangerous behavior that can lead to traffic accidents, and therefore is subject to serious sanctions in Turkey. For both your own safety and the safety of others on the road, drinking and driving can result in you facing criminal penalties. Here is detailed information about the penalties for drinking and driving and other situations you may encounter during this process:

Is Your Driver's License Confiscated?

The most common penalty for drunk driving is driver’s license suspension. As mentioned above, your first offense will result in your license being suspended for 6 months, your second offense for 2 years, and your third and subsequent offenses for 5 years. If your license is suspended, you will not be able to drive for the specified period.

Drunk Driving Penalty

According to the Traffic Law, driving under the influence of alcohol is a punishable offence when the per mille limit is exceeded. As of 2024, the penalties for driving under the influence of alcohol are as follows:

1. First Time Drinking and Driving:

  • The limits of 0.50 promil for private vehicles and 0.20 promil for commercial vehicles should not be exceeded. If you exceed these limits, you will be fined the first time. The fine for the first time caught is around 6.439 TL in 2024. This fine is updated every year according to the revaluation rate.
  • In addition, the driver’s license will be confiscated for 6 months.

2. Second Offense of Drinking and Driving:

  • If you are caught drunk driving for the second time, the fine can go up to 8.075  TL.
  • Your driver’s license will be revoked for 2 years.

3. Third and Subsequent Violations:

  • In the case of a third drunk driving offense, the penalties become even more severe. In this case, a fine of up to 12.977 TL** is paid.
  • Your license will be suspended for 5 years and you will also be required to obtain a psychotechnical evaluation report and a psychiatric specialist report.

These penalties are not limited to just money and driving license. If you are involved in an accident while driving, if you drive in an accident, or if you drive beyond the registered limits, you may face imprisonment.
