Can Criminals Be Identified by IP Address?

With the rapid spread of internet use, the concept of IP addresses has become important in terms of identifying people in the digital environment and detecting crimes. In this article, we will discuss in detail what an IP address is, what it does, and how it is used in legal processes.

What is an IP Address?

An IP address (Internet Protocol Address) is a unique number that identifies every device connected to the Internet. Devices connected to the Internet exchange data with each other via IP addresses. IP addresses are divided into two main types:

  • IPv4: It has a 32-bit structure and consists of a dotted four-digit number sequence (e.g. 192.168.1.1).
  • IPv6: It has a 128-bit structure and was developed so that many more devices can get IP addresses (e.g.: 2001:0db8:85a3:0000:0000:8a2e:0370:7334).

What is the Use of an IP Address?

IP addresses are necessary for data flow on the internet. In order for a device to connect to the internet and send and receive data, it must have an IP address. Its basic functions are:

  • Identification: Each device connected to the Internet is identified by its IP address.
  • Data Routing: Ensures that data packets on the Internet are delivered to the correct devices.
  • Geolocation: IP addresses are also often used to determine the physical location of the user.
 

Is it possible to detect a location using IP address?

IP addresses can be used to determine a general location of a user. However, this location determination is usually limited to a city or region. It is not possible to determine an individual’s exact address from an IP address. The location determination of an IP address depends on the internet service provider (ISP) and whether the users’ IP addresses are dynamic or static:

  • Static IP Address: A fixed IP address assigned to the device. This type of IP address can provide more accurate location detection.
  • Dynamic IP Address: IP addresses that change periodically by Internet service providers to users. Dynamic IP addresses are more difficult to locate and are generally less accurate.

Can Criminals Be Identified by IP Address?

An IP address is an important starting point for detecting digital crimes. However, it is not possible to definitely identify a criminal with just an IP address. Because an IP address indicates the device that is currently connected to the internet. Determining which person is using this device requires a more in-depth investigation. The process of identifying criminals based on IP address usually goes through the following stages:

  • IP Address Tracking: When a criminal digital activity is detected, an attempt is made to reach the user via the IP address.
  • Internet Service Provider (ISP) Information: It is determined which ISP the relevant IP address belongs to. The ISP records which subscriber this address is allocated to.
  • Legal Process: Authorities may request this information from the ISP by court order. However, this process must be supported by additional evidence in cases where the culprit cannot be fully identified based on the IP address alone.

Can a Lawsuit Be Filed Based on IP Address?

IP addresses have an important place in legal processes in terms of detecting digital crimes and using them as evidence. However, it is usually not enough to sue a person based solely on their IP address. Although courts may accept an IP address as evidence, this evidence must be reinforced with supporting evidence. Because an IP address indicates where an internet connection is being used, but does not provide definitive information about who is using this connection.

In such cases, additional evidence (e.g. log records, user movements, device traces, etc.) must be presented to the court. Especially in cybercrimes, the IP address is one of the most important elements that prosecutors and lawyers focus on. However, there are some elements to consider in cases based on IP addresses:

  • Public Wi-Fi Networks: If someone commits a crime using a public Wi-Fi network, it can be difficult to prove whether the crime was attributed to the person who established the connection via the IP address.
  • Dynamic IP Addresses: Dynamic IP addresses change from time to time and can be assigned to different users. This can make it difficult to pinpoint the person using the IP address at the time the crime was committed.

The IP address is the fundamental building block of identification and data exchange in the digital world. Although it plays an important role in location detection and criminal tracking, it is not always possible to identify a criminal with just the IP address. Although the IP address is used as strong evidence in legal processes, this evidence needs to be strengthened with supporting elements. As crimes committed on the internet become increasingly complex, legal studies on IP address detection continue to develop.
